This comment responds to a defence of the right to try, a law adopted by the United States and many state governments that seeks to expand access to experimental drugs. In defending the right to try, Meyerson argues that it is part of a broader rights-based approach for patient access to innovation. But a drug that is still part of the experimental process may not be an innovation—indeed, it may be a failure and even harmful or dangerous. Further, this approach (...) does not weigh other rights that may be at stake such as the property rights of the drug maker or the rights of future patients seeking access to cures. Lastly, research has found that many patients often fail to receive recommended treatments and preventive care from their providers, let alone experimental or innovative therapies. These policy problems suggest that there is a need for patients to have a greater involvement and role in their care and in how research funding is made, but the right to try fails to address these problems. Over the past 20 years or so, a small but growing literature has emerged with the aim of modeling agents who are unaware of certain things. In this paper we compare two different approaches to modeling unawareness: the object-based approach of Board and Chung (Object-based unawareness: theory and applications. University of Minnesota, Mimeo, 2008) and the subjective-state-space approach of Heifetz et al. (J Econ Theory 130: 78-94,2006). In particular, we show that subjectivestate-space models (henceforth HMS structures) can be embedded within (...) object-based models (henceforth OBU structures), demonstrating that the latter are at least as expressive. As long as certain restrictions are imposed on the form of the OBU structure, the embedding can also go the other way. A generalization of HMS structures (relaxing the partitional properties of knowledge) gives us a full converse. (shrink)

Explainable artificial intelligence (XAI) seeks to produce explanations for those machine learning methods which are deemed opaque. However, there is considerable disagreement about what this means and how to achieve it. Authors disagree on what should be explained (topic), to whom something should be explained (stakeholder), how something should be explained (instrument), and why something should be explained (goal). In this paper, I employ insights from means-end epistemology to structure the field. According to means-end epistemology, different means ought to be (...) rationally adopted to achieve different epistemic ends. Applied to XAI, different topics, stakeholders, and goals thus require different instruments. I call this the means-end account of XAI. The means-end account has a descriptive and a normative component: on the one hand, I show how the specific means-end relations give rise to a taxonomy of existing contributions to the field of XAI; on the other hand, I argue that the suitability of XAI methods can be assessed by analyzing whether they are prescribed by a given topic, stakeholder, and goal. PurposeThe purpose of this paper is to add one further value to the previously articulated “universal values” and to describe the constituent components of three universal values.Design/methodology/approachThis interpretive/constructivist study of Australia's largest online community of seniors involved a 30‐month ethnographic investigation. After an initial period of 11 months of observing social interaction on the entire site, in‐depth, semi‐structured interviews were conducted with 30 participants, selected according to criterion sampling, a form of purposive sampling.FindingsFour key moral values were identified: equality, freedom, (...) respect and trust. All of them had been found in other studies, with equality and respect (as human dignity) identified as universal values. The findings from this study suggest that freedom is another universal value.Originality/valueThis study extends the understanding of universal values to include freedom. Further, it demonstrates the constituent components for freedom, and those of two other universal values previously identified in the literature, equality and human dignity, as well as revealing linkages between these three values. Es werden vier Thesen vorgestellt und diskutiert: Dass die Religionswissenschaft eine transnationale Disziplin sei; dass sich die deutsche Religionswissenschaft in ihrer Forschung zunehmend auf Europa fokussiere, insbesondere auf das der Gegenwart; dass ihre Beteiligung am transnationalen Fachdiskurs gering und weiter rückläufig sei; und dass ein Zusammenhang zwischen den letzten beiden Punkten bestehe. In medizinethischen Kontexten bezeichnet der Ausdruck „Odysseus-Verträge“ Selbstbindungen, die in der vorausschauenden Bitte von Patienten an ihre Ärzte bestehen, eigene spätere Behandlungspräferenzen nicht zu befolgen. Umstritten ist jedoch, ob eine vorhergehende Anweisung ein Handeln gegen den Patientenwillen in der aktualen Behandlungssituation rechtfertigt. In diesem Beitrag wird die Frage nach der Verbindlichkeit von Odysseus-Anweisungen erörtert. Zunächst wird gezeigt, dass die Befolgung einer Odysseus-Anweisung eine Form des paternalistischen Handelns darstellt und die Frage nach der Verbindlichkeit von Odysseus-Anweisungen daher in diejenige nach der (...) Rechtfertigung paternalistischen Handelns zu überführen ist . Im Folgenden wird als Rechtfertigungsmodell für paternalistisches Handeln ein Zustimmungsmodell verteidigt , dem zufolge eine paternalisierende Maßnahme durch die antizipierte spätere Zustimmung des Patienten zu dieser Maßnahme gerechtfertigt wird . Nach einer Erörterung des Einwandes, dass damit die besonderen normativen Probleme von Odysseus-Anweisungen aus dem Blick geraten , werden abschließend Fälle untersucht, in denen aufgrund eines irreversiblen Kompetenzverlustes keine spätere Zustimmung zur paternalisierenden Maßnahme mehr möglich ist. In diesen Fällen, so die These, ist ein paternalistisches Handeln gegen den aktualen Patientenwillen nicht gerechtfertigt; kommt es hier also zu einem Konflikt zwischen dem in der Vorausverfügung dokumentierten und dem aktualen Patientenwillen, ist letzterer zu respektieren .In the context of medical ethics, the term „Ulysses contract“ denotes an advance directive by means of which a patient binds himself for the future by instructing a doctor to act against his foreseen future preferences. There is some controversy, however, about whether a person’s prior decisions should be regarded as mandatory for the doctor even when they conflict with her present desires. In this contribution, I address the questions whether and under what circumstances Ulysses instructions should be regarded as binding. In Part , I attempt to show that observing a Ulysses instruction means acting paternalistically and that therefore the question whether Ulysses contracts ought to be respected should be transformed into the question how paternalistic action can be justified. Parts and are concerned with the justification of paternalistic action. On the basis of a conception of welfare as being tied to the person’s interests and preferences, I defend a consent-based model of justification . More specifically, I suggest that the patient’s anticipated later consent to a precedent paternalistic action should count as its justification . In what follows, I attempt to rebut the objection that this account does not do justice to the specific normative problems of Ulysses contracts . Finally, I examine cases in which, due to an irreversible loss of competence, a paternalistic action cannot be assented to by the patient. I argue that in these cases, acting against the patient’s present wishes cannot be justified. If in such a case a patient’s present request runs contrary to the past request expressed in the advance directive, the former should be respected. (shrink)

Evidence‐based practice (EBP) first appeared on the healthcare horizon just over a decade ago. In 2003 its presence has intensified and extended beyond its initial relation to medicine embracing as it does now, nursing and the allied health disciplines. In this paper, I contend that its appearance and subsequent growth and development are the effects of potent ‘regimes of truth’, four of which bear the names: positivism, empiricism, pragmatism and economic rationalism. My aim is to show how EBP generates the (...) controversy it does because its nature and methods are inextricably interwoven with the way it has become politicised and professionalised. This exegesis is an attempt to outline how the combined effects of the four forms of rationality mentioned above allow for both the methods and objectives of EBP to be constructed as they are, while at the same moment producing the particular effects of knowledge and power in terms of who sells and who buys the idea of EBP in the culture of contemporary healthcare. Somites are transient structures which represent the most overt segmental feature of the vertebrate embryo. The strict temporal regulation of somitogenesis is of critical developmental importance since many segmental structures adopt a periodicity based on that of the somites. Until recently, the mechanisms underlying the periodicity of somitogenesis were largely unknown. Based on the oscillations of c-hairy1 and lunatic fringe RNA, we now have evidence for an intrinsic segmentation clock in presomitic cells. Translation of this temporal periodicity into a spatial (...) periodicity, through somite formation, requires Notch signaling. While the Hox genes are certainly involved, it remains unknown how the metameric vertebrate axis becomes regionalized along the antero–posterior (AP) dimension into the occipital, cervical, thoracic, lumbar, and sacral domains. We discuss the implications of cell division as a clock mechanism underlying the regionalization of somites and their derivatives along the AP axis. Possible links between the segmentation clock and axial regionalization are also discussed. (shrink)

Purpose Professional ethics is explored with three main foci: a critique of codes of conduct and the value of creating a global code for information and communication technology ; a critique of ICT professional certification; and the debate over whether ICT is really a profession. Design/methodology/approach This is a conceptual reflection on the current state of the ICT industry internationally, informed by the literature. Findings Compared to a mature profession, such as health, ICT is a young profession. This is evidenced (...) in the disparity of domains of practice, the lack of agreement on universal values governing the industry and the ongoing difficulties in creating international certification. Originality/value Until now, there has been little recognition of the corporatisation of ICT professionals and the effect that has on their ability to engage in appropriate professional ethics. More research is needed to explore appropriate ways in which ethical behaviour can be encouraged in the corporate workplace, including how professional development can be strengthened through building learning organisations. This study identifies the roles of consumers’ ethical orientations and CSR motives and the dynamics of these two variables on the subsequent consumers’ attitudinal and behavioral responses to CSR—perceived corporate authenticity and pro-firm behavioral intentions. To examine the impact of individual consumers’ ethical orientations, the authors measured consumers’ ethical orientations such as deontology and consequentialism through a Web-based survey conducted in Korea and in the USA. Further, to investigate the role of perceived CSR motives, the authors measured the perception of (...) a company’s business-oriented motives and society-oriented motives in conducting CSR. Results demonstrate the different role of ethical orientation in impacting consumers’ responses across these countries. Consumers’ consequentialist orientation appears to be positively associated with pro-firm behavioral intention in both the Korean and the US studies. In the Korean study, Consumers’ deontological orientation reduces perceived corporate authenticity when corporate motives seem business-oriented. Theoretical and practical implications are discussed. Perceptual expertise refers to learning that is specific to a domain, that transfers to new items within the trained domain, and that leads to automatic processing in the sense that expertise effects can be measured across a variety of tasks. It can be argued that most of us possess some degree of perceptual expertise in a least one, if not several domains, thereby giving the study of perceptual expertise broad application. Some object categories may in fact be objects of perceptual (...) expertise to the majority of people: Faces appear to be one such example. Thus, the use of face stimuli, or the comparison of face and object perception, can be a powerful way to ask whether a given process is influenced by perceptual expertise. Here, we emphasize one characteristic way that face processing appears to differ from nonface processing: that is, the degree to which they recruit a “holistic” rather than a “featural” perceptual strategy. This review brings evidence that expertise influences perceptual processing together with recent findings that the capacity of visual short-term memory is greater in perceptual experts and explores the relationship between the two. This paper presents an original, ambitious, truth-directed transcendental argument for the existence of an ‘external world’. It begins with a double-headed starting-point: Stroud’s own remarks on the necessary conditions of language in general, and Hegel’s critique of the “fear of error.” The paper argues that the sceptical challenge requires a particular critical concept of thought as that which may diverge from reality, and that this (...) concept is possible only through reflection on situations of error, in which how things are thought to be diverges from how things really are with independent items in an objective world. The existence of such a world is therefore a necessary condition of the possibility of scepticism: such scepticism is therefore false. I defend the argument against objections from Stroud’s sceptic and others. Drawing on Heidegger, the paper concludes by indicating that the chain of necessary conditions includes practical engagement with the world. (shrink)

Drawing on the work of John Rawls and Thomas Pogge, I argue that the U.S. is in part responsible for the immigration of Mexicans and Central Americans into the U.S. By seeking to further its national interests through its foreign policies, the U.S. has created economic and politically oppressive conditions that Mexican and Central American people seek to escape. The significance of this project is to highlight the role of the U.S. in illegal immigration so that we may first acknowledge (...) our responsibility in order to seek lasting humane solutions. This research has been facilitated by advances on several fronts: New methods are now available for viewing brain activity in real time, there is expanding information on the complexities of the biochemistry (...) of neural activity, individual genes can be isolated and their functions identified, analysis of the component processes included under the broad umbrella of "attention" has become increasingly sophisticated, and ingenious methods have been devised for measuring typical and atypical development of these processes, from infancy into childhood, and then into adulthood. In this book, Kim Cornish and John Wilding are concerned with attention and its development, both typical and atypical, particularly in disorders with a known genetic etiology or assumed genetic linkage. Tremendous advances across seemingly diverse disciplines - molecular genetics, pediatric neurology, child psychiatry, developmental cognitive neuroscience, and education - have culminated in a wealth of new methods for elucidating disorders at multiple levels, possibly paving the way for new treatment options. Cornish and Wilding use three specific-yet-interlinking levels of analysis: genetic blueprint, the developing brain, and the behavioral-cognitive outcomes, as the basis for charting the attention profiles of six well-documented neurodevelopmental disorders: ADHD, autism, fragile X syndrome, Down syndrome, Williams syndrome, and 22q11 deletion syndrome. Implicit in the value sensitive design (VSD) approach is a concern for understanding, and where possible, disrupting problematic power relationships. Yet an awareness of the issues and ethics of power relations is a pre-requisite for such a concern to bear fruit. This article provides some insight into the issues, and through a case study of technology design to support care arrangements for age-related cognitive decline, illustrates how finding a satisfactory resolution can be particularly troublesome.

ZusammenfassungUnter „Selbstbindungen“ versteht man in medizinethischen Kontexten vorwegnehmende Bitten von Patienten an ihre Ärzte, eigene spätere Behandlungspräferenzen nicht zu befolgen. In diesem Beitrag werden zwei Arten von Selbstbindungen voneinander unterschieden. Wird nach einer Phase des Kompetenzverlustes, für die ein Handeln gegen den Patientenwillen vorausschauend autorisiert wird, die Kompetenz wiedererlangt, handelt es sich um eine Odysseus-Anweisung. Wird aber, wie insbesondere im Falle von Anweisungen für das Spätstadium der Demenz, die Kompetenz nach der Behandlungssituation nicht wiedererlangt, liegt eine Selbstbindung vor, die jedoch (...) keine Odysseus-Anweisung ist. In Bezug auf die erste Art von Selbstbindungen kommt die erwartete spätere Zustimmung des Patienten als Rechtfertigungskriterium für ein Handeln gegen den Patienwillen in Betracht. In Bezug auf die zweite Art von Selbstbindungen ist hingegen zu fragen, ob der Wille des Patienten in der Behandlungssituation als Widerruf des früheren Willens der kompetenten Person gelten kann. Ist dies der Fall, ist der zum früheren Zeitpunkt geäußerte Wunsch nicht mehr als derjenige einschlägig, der festlegt, was der Patient in der Behandlungssituation will. (shrink)

S. C. Gibb holds that some mental events enable physical events to take place by acting as ‘double preventers’ which prevent other mental events from effecting change in the physical domain. She argues that this enables a dualist account of psychophysical interaction consistent with the causal relevance of mental events, their distinctness from physical events, the causal closure of the physical and the exclusion of systematic overdetermination. While accepting the causal powers metaphysic, this paper argues that: Closure is maintained only (...) on the assumption of an implausible pre-ordained harmony between preventing and double-preventing mental events. Distinctness is preserved only at the cost of positing brute unexplained powers of mental and physical events to causally interact with each other. Exclusion is systematically violated in a substantial number of everyday cases. The case for Relevance made by the Double Prevention model is accordingly too weak to sustain a dualist approach to mental causation. (shrink)

The COVID-19 pandemic plunged economies into recessions and advancements in artificial intelligence create widespread automation of job tasks. A debate around how to address these challenges has moved the introduction of a universal basic income (UBI) center stage. However, existing UBI research mainly focuses on economic aspects and normative arguments but lacks an individual perspective that goes beyond examining the association between socio-demographic characteristics and UBI support. We add to this literature by investigating not only socio-demographic but also psychological predictors (...) of UBI acceptance in a multivariate analysis using a representative sample of the German working population collected in 2020 (N = 1986). Our results indicate that being more supportive of a UBI went along with being comparably younger, of East-German origin, and more in favor of equal living standards, as well as perceiving one’s economic situation to be worse and the threat of the corona-pandemic to be higher. We used functional magnetic resonance imaging to examine the interactive effects of perceived competence and task interest on the cognitive and affective responses to negative feedback. Twenty-four undergraduates performed both interesting and uninteresting tasks and received failure feedback. The participants’ perceived competence in the task was manipulated between subjects prior to scanning with bogus feedback. The results showed that negative feedback processing was contingent upon both perceived competence and task interest. The most adaptive coping mechanism, indicated by activation in the (...) cognitive control network and attenuation in the negative affect region, was identified for the high-competence and high-interest combination. When either competence or interest was low, signals in the cognitive control network were weaker. The most detrimental activation patterns were observed for the combination of low-competence and high interest. Our results reveal the combination of task and learner characteristics that best harnesses the potential benefits of negative feedback and illustrate the neuroscientific mechanisms underlying this observation. In the conclusion to “A World of Pure Experience”, William James writes, “experience grows by its edges.” I explore what this may mean vis-à-vis Chicanx culture and Spanglish to argue that Chicanxs are neither a bastardization of Anglo or Mexican people and culture, nor is Spanglish a bastardization of English or Español, and that in some ways Chicanxs feel their Mexicanidad more palpably than Mexicans who live in the interior of Mexico, where one’s Mexicanidad is not a predominant identifier. I (...) first explain the process metaphysics that James espouses as well as his view of the lived experience. I build on these two Jamesian concepts and work with the chapter “The Pachuco and Other Extremes” from Octavio Paz’s The Labyrinth of Solitude, as well as Gloria Anzaldúa’s Borderlands/La Frontera to explore the experience of being a Chicana and speaking Spanglish on the U.S-Mexico border. _Skepticism and Cognitivism_ addresses the fundamental question of epistemology: Is knowledge possible? It approaches this query with an evaluation of the skeptical tradition in Western philosophy, analyzing thinkers who have claimed that we can know nothing. After an introductory chapter lays out the central issues, chapter 2 focuses on the classical skeptics of the Academic and Pyrrhonistic schools and then on the skepticism of David Hume. Purpose This study aims to explore how health informatics can underpin the successful delivery of recovery-orientated healthcare, in rural and remote regions, to achieve better mental health outcomes. Recovery is an extremely social process that involves being with others and reconnecting with the world. Design/methodology/approach An interpretivist study involving 27 clinicians and 13 clients sought to determine how future expenditure on ehealth could improve mental health treatment and service provision in the western Murray Darling Basin of New South Wales, Australia. (...) Findings Through the use of targeted ehealth strategies, it is possible to increase both the accessibility of information and the quality of service provision. In small communities, the challenges of distance, access to healthcare and the ease of isolating oneself are best overcome through a combination of technology and communal social responsibility. Technology supplements but cannot completely replace face-to-face interaction in the mental health recovery process. Originality/value The recovery model provides a conceptual framework for health informatics in rural and remote regions that is socially responsible. Service providers can affect better recovery for clients through infrastructure that enables timely and responsive remote access whilst driving between appointments. This could include interactive referral services, telehealth access to specialist clinicians, GPS for locating clients in remote areas and mobile coverage for counselling sessions in “real time”. Thus, the technology not only provides better connections but also adds to the responsiveness of any treatment available. (shrink)

This paper argues that the standard formulations of the question of how consciousness emerges, both synchronically and diachronically, from the physical world necessarily use a concept of the physical without either a clear grasp of the concept or an understanding of the necessary conditions of its possibility. This concept will be elucidated and some of the necessary conditions of its possibility explored, clarifying the place of the mental and the physical as abstractions from the totality of an agent engaged in (...) the life world. The notion of a disruption or breakdown in the agent’s normal engagements in the world will play a key role in the argument, which in turn provides a transcendental underpinning to recent enactive and embodied theories of mind by exploring some of the necessary conditions of being an agent in the world. Machine learning operates at the intersection of statistics and computer science. This raises the question as to its underlying methodology. While much emphasis has been put on the close link between the process of learning from data and induction, the falsificationist component of machine learning has received minor attention. In this paper, we argue that the idea of falsification is central to the methodology of machine learning. It is commonly thought that machine learning algorithms infer general prediction rules from past (...) observations. This is akin to a statistical procedure by which estimates are obtained from a sample of data. But machine learning algorithms can also be described as choosing one prediction rule from an entire class of functions. In particular, the algorithm that determines the weights of an artificial neural network operates by empirical risk minimization and rejects prediction rules that lack empirical adequacy. It also exhibits a behavior of implicit regularization that pushes hypothesis choice toward simpler prediction rules. We argue that taking both aspects together gives rise to a falsificationist account of artificial neural networks. (shrink)

An important feature of some recent jurisprudential writings is the tendency to reject the precept of liberal individualism which affirms the priority of the principles of the "right conduct" over the substantive conceptions of "the good". This rejection, explicit in a recent book by Rogers M. Smith, and implicit in a recent work by Guido Calabresi, leads to strikingly illiberal consequences; hence, this provides indirect confirmation that the priority of the right over the good constitutes the most reliable defense of (...) individual liberty against majoritarian oppression. In Smith, an attempt to replace this priority with the principle of "rational liberty" leads to the disappearance of the guarantees of minority rights against orthodox majorities; in Calabresi, the doctrine of weighing and balancing competing moral principles of "the good" fails to provide an explanation for the strongly held moral intuition that some external preferences have to be disqualified at the outset, before they enter the forum of moral bargaining. It presents the findings of a meta-analysis of many studies on the collective environmental decision-making processes, focusing on examples of public participation initiated to agree on relevant public decisions. The samples required for the meta-analysis are taken from a database of 200 case studies of (...) collaborative environmental management in Western countries. The sample cases are selected according to the comprehensiveness of available information derived from North America, demonstrating the significance of participatory governance in the United States and Canada.
